Contractural Agreement

  • Prior to work being undertaken, it is encouraged that clear written communication is agreed between Cuttingedge-tiling and the customer prior to contract commencing as this ensures a mutual understanding regarding project layout and design requirements.
  • The Contract and these Terms constitute the entire agreement between Cuttingedge-Tiling and the Customer. All prior negotiations, representations, understandings, arrangements and agreements (whether oral) are superseded by the Contract and these Terms.
  • The Contract and these Terms will in all circumstances prevail over the Customer's terms and conditions (if any), unless Cuttingedge-Tiling agrees in writing to be bound by the Customer’s terms and conditions or any of them.

Characteristics of Goods

The Customer acknowledges that Goods, which are tiles, supplied by Cuttingedge-Tiling may contain, display or be subject to any one or more of the following characteristics:

  • crazing, spots, specks and blemishes
  • variations in colour, shade, size, pattern, veining, marking, texture, durability, density, size, weight, dimension, surface and finish, and may fade or change colour over time; and
  • optical effects such as hazing or smudging at varying light sources and at differing angles

The Customer acknowledges that Goods which contain, display or are subject to any one or more of the characteristics referred to in clause Characteristics of Goods are not defective or of unacceptable quality by reason of any of those characteristics.

Cuttingedge Tiling are not liable for any materials that are not supplied by or recommended by us, this includes all adhesives and grouts. Tiles which are purchased by our clients are at there discretion and we can not be held liable for shading differences, tile size differences, bows or defects in the structure of the tile.

Copyright

Cuttingedge-Tiling owns the copyright for the information and images available on Cuttingedge-Tiling website, unless otherwise indicated.  The use of any image or text for commercial gain is strictly prohibited. Where any of the Cuttingedge-Tiling copyright items on this site are being republished or copied to others, the source of the material must be identified and the copyright status acknowledged.

Terms of Payment

Payment Terms will be agreed between Cuttingedge-Tiling and the client before the job comences.

Confidentiality

"Company's Confidential Information" means any commercial information of Company, any information contained within instruction manuals or other documents provided to Client and any other information related to Services. Client will keep all Company's Confidential Information confidential for a period of 3 years after termination of this Agreement or any related agreement with Company. Client may not disclose Company's Confidential Information to any third party without Company's prior written consent. Client may share Company's Confidential Information with only its employees who have a need to know and who are subject to legally binding obligations to keep such information confidential. Confidentiality obligations in this clause do not apply to Company's Confidential Information that (a) Client can demonstrate was in its possession before receipt from Company; (b) is or becomes publicly available through no fault by Client; (c) is rightfully received by Client from third party without duty of confidentiality. If Client is required by government body or court of law to disclose any Company Confidential Information, Client shall give Company reasonable advance notice so that Company has an opportunity to contest disclosure.

Virus Protection

We make every effort to check and test material at all stages of production. It is always wise for you to run an anti-virus program on all material downloaded from the internet. We cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur whilst using material derived from this website.

Governing Laws

The terms and conditions of use of Cuttingedge-Tiling website shall be governed by the laws of Scotland.
